Galaxy Graphic Card Warranty (North America Region)
Limited 2 years warranty
Galaxy Microsystems Ltd (“GXM”) hereby confirm and warrants this Graphic Card to be free from defects inmaterials and workmanship for a period of 2 years from the date of sales receipt as sold to the original purchaser(“Purchaser”), subject to all the terms and conditions as specified here.GXM’s sole obligation under this warranty is to replace or, at its option, to repair, free of charge, all the product’sdefective parts. This warranty applies only on the condition that the product has been installed, maintained andoperated under conditions of normal use and in accordance with the installation guide provided herewith. The provisions of this warranty shall not apply if, in GXM’s sole judgment, the product has been subject to misuse orneglect, improper installation, damaged in an accident, or repaired or altered in any way that affects its performance or reliability.
This warranty is only valid if the product:
1、Was not damaged while being installed
2、Was not damaged by software or hardware from a company or individual other than GXM or bymotherboard incompatibility
3、Was operated in accordance with GXM specifications, instructions and any technical support directions
4、Was not modified or damaged by overclocking, tampering, user error, accident, disaster, abuse, misuse,power supply, power application, alteration, repair, modification, a fix or replacement by someone otherthan GXM
5、Third party products, such as motherboards and other system components using or interacting with thisProduct are not covered by this warranty.
THIS WARRANTY IS IN LIEU OF ANY OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED,INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR APARTICULAR PURPOSE OR TITLE AGAINST INFRINGEMENT, WHICH OTHER WARRANTIES AREEXPRESSLY EXCLUDED AND DISCLAIMED. GXM SHALL NOT BE LIABLE FOR LOSS OF PROFITSOR ANY SPECIAL, INCIDENTAL, EXEMPLANARY, CONSEQUENTIAL OR PUNITIVE DAMAGESWHICH PURCHASER OR THIRD PARTY MAY SUSTAIN, EVEN IF GXM HAS BEEN ADVISED OF THEPOSSIBILITY OF SUCH LOSSES OR DAMAGES. IN NO EVENT SHALL GXM’S LIABILITY EXCEEDTHE PURCHASE PRICE OF THE DEFECTIVE PRODUCT.
Purchaser acknowledges that the goods sold by GXM are being used or incorporated into other products orsystems, and the ultimate safety of those products or systems are the sole responsibility of Purchaser. Purchaserassumes all risks and liability of use of GXM products in other products or systems. By way of example, and notlimitation, if any GXM product is used in the military, including but not limited to strategic weapons and ancillarymilitary operations, Nuclear Facilities, Aircraft Navigation, or Communication Systems, Air Traffic ControlSystems or Life Support Machines, Purchaser agrees that it and/or its customers are solely responsible and agreesthat the use of GXM products for any purpose related to such services or otherwise cannot in any way becontrolled by GXM, and Purchaser or its customers are responsible for verifying the accuracy and completeness ofany information contained in, entered into, or used in connection with GXM products. Purchaser assumes allrisks and liability for use of GXM products in other product or systems. In addition, GXM is not responsible forany archival, backup or disaster recovery services. In no event shall GXM be liable for any damages of any kindsustained by Purchaser, any customer of Purchaser, any patient, or others for any suit or claim or demand arisingfrom or related to the exercise of professional judgment and skill, or data entered into or used with the GXMproducts.
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTIAL ORCONSEQUENTIAL DAMAGES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTSWHICH VARY FROM STATE TO STATE. THIS WARRANTY SHALL NOT BE EXTENDED, ALTERED ORVARIED EXCEPT BY A WRITTEN INSTRUMENT DULY SIGNED BY GXM.

Purchaser pays for shipping RMA product to GXM. Customer assumes the risk of loss (insurance from loss ordamage) in transit and the returned Products shall become the sole property of GXM. GXM warrants that therepaired or replaced Products will be free from defects in material or workmanship.
GXM reserves the right to inspect and verify the defectiveness of any product returned. Please allow 48 hrsprocessing time once item has been received by GXM, and 3 – 5 days for shipping of the repaired or replacementproduct (shipped ground to the U.S.).
GXM will cover the cost of return shipping back to the buyer for RMA replacements via ground shipping throughUSPS in the United States and Canada.
