Warranty Policy
Galaxy Graphic Card Warranty (North America Region) Limited 2 year warranty.
Galaxy Microsystems Ltd (“GXM”) hereby warrants this Graphic Card to be free from defects in materials and workmanship for a period of 2 years from the date of sales receipt as sold to the original purchaser (“Purchaser”), subject to all the terms and conditions as specified herein. GXM’s sole obligation under this warranty is to replace or, at its option, to repair, free of charge, all the product’s defective parts.
This warranty is only valid if the product:
1. Was installed per GXM instructions ;
2. Was not damaged during installation or removal from the computer ;
3. Was not damaged by software or hardware, including software or hardware incompatibility ;
4. Was maintained and operated under conditions of normal use in accordance with GXM specifications ;
5. Was not damaged by overclocking or modification by someone other than GXM.
Any modification made to the Product must be reversed prior to shipment back to GXM for warranty service. Product must be in original factory condition to receive warranty service. Determination of damage or defect, as a result of any modifications or overclocking by purchaser, will be at the sole discretion of GXM. Any charges arising due to modification will be the responsibility of the Purchaser.
Any return shipping fees may, at GXM’s sole discretion, be the responsibility of the Purchaser if the product is not covered by the warranty.
THIS WARRANTY IS IN LIEU OF ANY OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR TITLE AGAINST INFRINGEMENT, WHICH OTHER WARRANTIES ARE EXPRESSLY EXCLUDED AND DISCLAIMED. GXM SHALL NOT BE LIABLE FOR LOSS OF PROFITS OR ANY SPECIAL, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL OR PUNITIVE DAMAGES WHICH PURCHASER OR THIRD PARTY MAY SUSTAIN, EVEN IF GXM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSSES OR DAMAGES. IN NO EVENT SHALL GXM’S LIABILITY EXCEED THE PURCHASE PRICE OF THE DEFECTIVE PRODUCT.
Purchaser acknowledges that the goods sold by GXM are being used or incorporated into other products or systems, and the ultimate safety of those products or systems are the sole responsibility of Purchaser. Purchaser assumes all risks and liability of use of GXM products in other products or systems. Purchaser agrees that it and/or its customers are solely responsible and agrees that the use of GXM products for any purpose related to such services or otherwise cannot in any way be controlled by GXM, and Purchaser or its customers are responsible for verifying the accuracy and completeness of any information contained in, entered into, or used in connection with GXM products. Purchaser assumes all risks and liability for use of GXM products in other product or systems. Third party products and/or systems are including but not limited to motherboards and other system components are not covered by this warranty. In no event shall GXM be liable for any damages of any kind sustained by Purchaser, any customer of Purchaser, or others for any suit or claim or demand arising from the use of GXM products.
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. THIS WARRANTY SHALL NOT BE EXTENDED, ALTERED OR VARIED EXCEPT BY A WRITTEN INSTRUMENT DULY SIGNED BY GXM.
Warranty coverage requires proof of purchase documentation evidencing the date of purchase (sales receipt or invoice) and original packaging. Purchaser pays for shipping product to GXM for warranty. Customer assumes the risk of loss (insurance from loss or damage) in transit and the returned Products shall become the sole property of GXM. GXM warrants that the repaired or replaced Products will be free from defects in material or workmanship for the remainder of the original product’s warranty term.
GXM reserves the right to inspect and verify the defectiveness of any product returned. Please allow 48 hours processing time once item has been received by GXM, and 3–5 business days for shipping of the repaired or replacement product.
Return to purchaser shipping fees for repaired or replacement product will be paid for by GXM. Repaired or replacement products will be shipped via USPS in the United States and Canada.
